CONDITIONS OF PARTICIPATION & TERMS AND CONDITIONS: COMPETITION

1. General

By participating in the competition held on Facebook or Instagram, the participant accepts the following conditions:

The competition starts and ends on the date stated in the competition post. The competition will be held on the social media channels stated in the post. Participation is only possible during this period. The competition ends when the winners are announced.

To take part in the competition, users must fulfill the conditions of participation stated in the competition post, for example liking the Geigercars Facebook page, etc.

The Geigercars jury will randomly select the winners from all participants who meet the competition conditions listed. They will be selected after the closing date and notified in the post with a comment on Facebook or Instagram and asked to send their contact details (name, address) via a private Facebook or Instagram message to the respective Geigercars social media account. Each winner must contact Geigercars with their address details in a private message within 3 days. If the deadline has passed, the next winner will be contacted. After receiving the address details, the prizes will be sent to the winner.

2. Organizer

The organizer of the competition is GeigerCars.de GmbH Zamdorfer Straße 6-8 D-81677 Munich

All information and data provided or collected by participants during the competition will only be provided to Geigercars as the organizer and not to Facebook or Instagram. Geigercars releases Facebook or Instagram from any claims by third parties in connection with this promotion.

3. Participants

Participation via competition clubs or participation and registration services, automated participation and multiple participation are not permitted.

Participation is only permitted with Facebook or Instagram accounts that can be traced back to a real person. Participation with fake identities or with the identities of third parties is not permitted.

Participants may be required to provide evidence of their eligibility to participate in the competition. If participants do not provide evidence of their eligibility within the deadline set by Geigercars, Geigercars reserves the right to exclude participants from participation.

Geigercars employees and their families are excluded from participation.

Geigercars reserves the right to delete comments that violate these terms and conditions, the Facebook or Instagram guidelines, German law, copyright or the Geigercars Facebook or Instagram netiquette. The participant will be excluded from the competition.

4. Prizes & Prize Transfer

The advertised prize is described in the posting text of the respective competition posting. The prize will be sent by post after the winner has been notified to the address that the participant provided when entering. The prize will be sent and shipped by Geigercars.

Cash payment of the prize is not possible. Any prizes are not transferable. Legal recourse is excluded.

5. Rights

By participating, the participant grants Geigercars the non-exclusive, free right to publish the posted text and photos on the Facebook page https://www.facebook.com/GeigerCars.de/ or the Instagram page https://www.instagram.com/Geigercars/ For the purpose of awarding the prize, the participant consents to the use of his/her profile photo.

By participating, the participant confirms that he/she has full rights to the posted text and photo, or that he/she is permitted to post them for the competition.

By participating, the participant confirms that he/she has the relevant consents of third parties, provided that they can be recognized on the picture he/she has posted, and that he/she can provide them in writing if necessary. If, contrary to the above confirmations by the participant, the rights of third parties are infringed by the publication of the answer to https://www.facebook.com/GeigerCars.de/ or https://www.instagram.com/Geigercars/ are injured, the participant releases Geigercars from all costs, in particular compensation payments to the injured party.

6. Data Protection

Personal data is stored solely for the purpose of conducting the competition. The data will not be passed on to third parties unless this is necessary to conduct the competition. The data from the competition participation will be deleted three months after the end of the competition. The legal basis for conducting the competition is Art. 6 Para. 1 lit. b) EU GDPR.

7. Disclaimer

Geigercars accepts no responsibility for data loss, especially that which occurs during data transmission, technical defects, and lost, damaged or delayed entries. Any warranty claims by the winners are excluded.

8. Change/Termination of the Competition

Geigercars reserves the right to change or cancel the competition in the event of unforeseen circumstances. Geigercars is particularly entitled to cancel, terminate or suspend the competition if:

• an attempted abuse through manipulation is detected,
• during the implementation of the competition, Facebook or Instagram's promotional guidelines were changed so that implementation would not be possible in accordance with the valid regulations of Facebook or Instagram or the competition was stopped for any reason whatsoever by Facebook or Instagram,
• proper execution can no longer be ensured, in particular in the event of hardware or software failure, program errors, computer viruses or unauthorized intervention by third parties as well as mechanical, technical or legal problems.

9. Contact

All questions, comments or complaints should be directed to Geigercars. Complaints relating to the implementation of a promotion should be directed to Geigercars within 14 days of the reason becoming known, stating the promotion.
